MCE Legal Update Course & Ethics Course FAQs for Educators


  1. Q:  Who can offer the MCE Legal Update or Ethics courses that have been developed for TREC?

    A:  Only TREC approved MCE providers may offer the MCE Legal Update or Ethics courses for MCE credit.

  2. Q:  We are a TREC approved MCE provider. How do we obtain approval to offer the Legal Update or Ethics courses that have been developed for TREC?

    A:  As a TREC approved MCE provider you may offer the Legal Update or Ethics course by filing a Course Application Supplement (MCE Form 3B-3) and paying a $100 filing fee for the course you plan to offer.

  3. Q:  We are not a TREC approved MCE provider. How do we obtain approval to offer the Legal Update or Ethics courses that have been developed for TREC?

    A:  You must first obtain approval as an MCE provider. Please print and complete the MCE provider application forms from the TREC website. The MCE Provider Application fee is $400 for a two-year term. If interested in becoming an MCE provider contact the TREC Education staff at 512-465-3981 for a brief telephone discussion prior to submitting an application.

  4. Q:  Who can we get to teach the Legal Update or Ethics courses?

    A:  These courses must be taught by an instructor who is approved by TREC as a Core instructor with a college degree in the subject area or with professional experience in the subject areas of Principles of Real Estate, Law of Agency, and Law of Contracts. The instructor must also be certified by attending the instructor training sessions for these courses offered through the Real Estate Center.

  5. Q:  How can we combine one or more of our MCE elective courses with the Legal Update and/or Ethics course to meet the 15 hour MCE requirement?

    A:  You may do so by using the MCE Course Application form. You must include a cover letter and paragraph explaining the relevance of the course as well as notification that along with the MCE elective course the provider intends to combine it with one or more of the required courses (legal update and/or ethics). You must pay the $100 course application filing fee when an MCE elective course is combined with one or both required courses. For example: To offer the Legal Update and Ethics course with a 9 hour MCE elective course in property management, you must submit the course application and $100 fee and include a paragraph or cover letter stating that this is your intent.

  6. Q:  I am a TREC approved provider. Can I submit MCE instructor applications with my Course Application Supplement form for the instructors that will teach my legal update and ethics courses?

    A:  Yes. However, the Core instructor application filing fees must not be combined with filing fees for the Course Application Supplement. Also, please recall that to teach these courses an instructor must not only be approved through TREC as a Core instructor in these subject areas, but must also be certified to teach the Legal Update and Ethics courses by attending the instructor training sessions.

  7. Q:  I am approved to teach Core courses. How can I teach the legal update or ethics courses?

    A:  You must be approved by TREC in the subject areas of Principles of Real Estate, Law of Agency, and Law of Contracts and get certified to teach the legal update or ethics courses by attending the instructor training sessions offered by the Real Estate Center. You may register to attend by contacting the Real Estate Center at: http://recenter.tamu.edu/register

  8. Q:  I am a TREC approved Core instructor and will be certified to teach the legal and ethics course. My approval as a Core instructor expires the end of February 2010. Can I continue to teach the Legal Update and Ethics courses under my certification even after my instructor approval expires?

    A:  No. You will not be allowed to teach any course if your instructor approval expires. You should receive an instructor renewal notice about 60 days prior to the expiration of your instructor approval. Even if you do not receive a renewal notice from TREC, it is your responsibility to know when your instructor approval expires and to contact us regarding renewal. If you are both a Core and MCE legal update or ethics instructor, you must submit a copy of the renewal letter with the appropriate filing fee and Instructor Application (Form ED 4-2). When submitting Form ED 4-2 for renewal, complete only item numbers 1 through 6 and 9 through 11 on the form and provide your signature and date.
