Agenda Item 1 Call to Order
ACTION: Secretary Sales called the meeting to order at 10:01 a.m.

Agenda Item 4 Discussion regarding file retention for brokers and sales agents as defined in 22 TAC §535.2, Broker Responsibility
ACTION: Bob Baker, seconded by Ty Williams, moved to recommend the new Broker Responsibility Advisory Committee examine issues in this rule related to the file retention for brokers and sales agents. Bill Roth made a friendly amendment to ask that the new committee define "substantive communication". The motion was adopted by unanimous vote.
Agenda Item 5 Discussion and possible action regarding broker associates
ACTION: The committee decided by consensus to recommend the new Broker Responsibility Advisory Committee define "broker associate", explore how TREC can regulate broker associates, define the different responsibilities between a broker and broker associate, explore ways to notify the brokerage of any disciplinary action against the broker associate, and how to display the broker associate's affiliation with a brokerage on the TREC website.
Agenda Item 6 Discussion regarding the number of LLCs or sales agents a broker can sponsor or supervise
ACTION: Yazmin Perez, seconded by Ty Williams, moved to recommend the new Broker Responsibility Advisory Committee explore the structure of broker supervision. The motion was adopted by unanimous vote.
Agenda Item 7 Discussion and possible action regarding future agenda items for consideration and meeting dates for the Broker Responsibility Advisory Committee
• Suggested future meeting date: Wednesday, January 17, 2024
• Alternate date: Thursday, January 18, 2024
ACTION: The committee requested the new Broker Responsibility Advisory Committee review the working group's former recommendation regarding education and experience requirements to become a broker.
The first meeting for the new Broker Responsibility Advisory Committee is January 17, 2024, at 10:00 a.m.
